Se declaró que es el Tribunal de la referencia quien debe continuar con la competencia de la solicitud instaurada por el accionante, en razón de que se trata de petición de protección a derechos fundamentales tramitable como acción de tutela.
La Corte argumentó que es riesgoso para una sociedad democrática el acudir a la literalidad de una norma citada cuando todo el contexto de una solicitud apunta hacia la protección inequívoca de unos derechos fundamentales.
En consecuencia, se ordenó enviar el expediente a dicho Tribunal para que tome las decisiones pertinentes.

- Segundo. ORDENAR el envio del expediente a dicho Tribunal para que tome las decisiones pertinentes de dicha tutela.
